Additionally, a secondary franchise purchase contract is arranged, establishing the applicant as a partner in the limited partnership of Gibsons Utopia. This secondary business contract includes the franchise price as outlined in the franchise catalog, as well as the apartment price.
    • Concurrent with the above processes, the applicant should begin the process of property transfer or fund transfer to Canada to meet the financial requirements of both the secondary and migration contracts according to the payment terms. This stage is managed in Iran by the Iran Contract Affairs Unit and the Real Estate and Properties Unit of Parsi Canada’s International Group in Iran.
    • Upon completion of Step 3, the applicant participates in an online session with a Canadian attorney. After identity verification by the attorney, the applicant’s construction franchise as a limited partner is established and ownership is transferred to the applicant. This step is conducted in Canada by the Lawyer Corporation.
    • The subsequent step involves drafting the Joinder Agreement and Subscription Agreement by the Contract Affairs lawyer in Canada in the applicant’s name and for the applicant’s construction franchise limited partnership. (Attachments No. 2 and 3) This stage is also carried out in Canada by the Lawyer Corporation.
    • After completing Step 5, another online session is held with the lawyer to sign the agreements via the official DocuSign platform. Instead of sending it directly to the applicant electronically, upon request, the contracts may also be sent to a notary office in Canada or Iran. The applicant can then visit these offices to sign the documents. This step is conducted in both Canada and Iran by the Lawyer Corporation.
    • After the immigration process is completed, all Iranian contracts from the applicant must be returned.
  2. Taxes and Other Additional Costs:

    • In British Columbia, a “Foreign Buyers’ Tax” applies to individual foreign property buyers (not companies), amounting to 20% of the property’s purchase price. This tax is implemented in areas where the foreign property transfer tax law is enforced, including Metro Vancouver and its surrounding areas, such as Gibsons. However, by investing through franchise purchase and limited partnership, this tax is treated as an internal corporate matter, effectively reducing it to zero.
    • In addition to this tax, individual (not corporate) buyers must pay a regular property transfer tax calculated as follows:
      1. 1% for the first $200,000 of the purchase price.
      2. 2% for the price portion between $200,000 and $2,000,000.
